What happened

The Landlord applied to terminate the tenancy because the Tenant breached a mediated settlement by failing to pay an arrears installment. An ex parte order was issued on October 15, 2025. The Tenant filed a motion to set aside that order, citing extreme financial hardship and lack of funds. Evidence revealed the Tenant does not live in the unit full-time, while her adult son lives there without contributing to rent, despite the unit being a subsidized two-bedroom residence with a long waitlist.

The ruling

The Tenant's motion to set aside the eviction order is denied. The stay of eviction is lifted effective December 12, 2025. The Adjudicator found it unfair to continue the tenancy given the Tenant's failure to pay, lack of full-time residency, and the son's failure to contribute to rent while thousands wait for social housing.
