What happened

The Landlord applied to terminate the tenancy and evict the Tenant due to significant rent arrears. The Tenant contested the arrears amount, claiming he did not receive rent increase notices and that he performed repair work in lieu of rent. The Tenant also attempted to raise section 82 maintenance issues at the hearing without prior disclosure.

The ruling

The Tenant is ordered to pay $11,746.04 in arrears and costs. However, relief from eviction is granted provided the Tenant follows a 12-month payment plan of $1,000.00 monthly (plus a final installment) while staying current with future rent. If the Tenant misses any payment, the Landlord may apply for an eviction order without further notice.
