What happened

The Landlords filed an A1 application with the Board to determine whether the Residential Tenancies Act, 2006 applies to the current living arrangement with the Tenant. The Landlords argued that the exemption in section 5(a) of the Act applies, as the rental unit was intended for the travelling or vacationing public. The Tenant believed she was a tenant and should be afforded the protections under the Act.

The ruling

The Board found that the exemption in section 5(a) of the Residential Tenancies Act, 2006 applies to the living arrangement between the Landlords and the Tenant, as the rental unit was intended for the travelling or vacationing public. Therefore, the Act does not apply to this situation.
