What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenants because they failed to meet a payment condition set in a previous LTB order. An ex parte order (issued without a hearing) was initially granted to the Landlord. The Tenants filed a motion to set aside that order, claiming technical issues with uploading evidence and alleging the Landlord was being evasive regarding the acceptance of rent payments. The Landlord's representative argued that the Tenants had not made payments since June 2025.
The ruling
The Tenants' motion to set aside the eviction order was denied. The LTB found that the Tenants breached the conditions of a previous order by failing to pay rent arrears. Consequently, the stay on the eviction order issued on July 3, 2025, is lifted, and the original order for termination of the tenancy and eviction remains in effect.
