What happened

The Landlords applied to terminate the tenancy due to non-payment of rent. The Tenants owed substantial arrears but requested a payment plan, citing a new roommate moving in to help with costs. The Landlords objected to the plan, expressing concerns about the new occupant potentially bringing children, which they claimed would increase utility usage. The Board applied Section 83 to grant relief from eviction, establishing a 12-month conditional payment schedule.

The ruling

The LTB ordered the Tenants to pay $13,586.00 in arrears and costs through a structured payment plan ending in December 2026. Relief from eviction was granted provided the Tenants make all scheduled payments and pay their ongoing monthly rent in full and on time. If any payment is missed, the Landlords may apply for an ex parte eviction order under Section 78.
