What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to substantial interference with reasonable enjoyment, specifically regarding unpaid water utility bills. The Landlord also sought compensation for out-of-pocket expenses resulting from the Tenant's failure to pay these utility costs. The Tenant vacated the rental unit prior to the hearing, rendering the termination request moot, but the Board proceeded to address the claim for unpaid utility expenses.
The ruling
The Tenant is ordered to pay the Landlord $573.06 for unpaid water utility costs by August 12, 2025. As the Tenant vacated the unit on April 1, 2025, the application for termination of the tenancy and eviction is no longer necessary. If payment is not made by the deadline, interest will accrue at a rate of 4.00% annually.
