What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Tenant raised a preliminary issue, claiming her daughter and brother were also tenants and should have been served the notice, which the Board dismissed as they were not on the lease. The Tenant asserted that rent was paid directly by Ontario Works, but provided no evidence to support this claim. The Landlord denied receiving any payments for a 15-month period.
The ruling
The tenancy is terminated unless the Tenant pays the Landlord $20,186.00 by June 30, 2025. If the payment is not made, the Tenant must vacate by that date and is ordered to pay the Landlord $17,280.95, plus daily compensation of $41.10 from May 23, 2025. The eviction is delayed until June 30, 2025, to provide the Tenant an opportunity to find new housing or funds.
