What happened

The Landlord applied for the termination of tenancy and eviction of the Tenant due to significant rent arrears. The Tenant argued that he did not actually live in the unit and that an occupant was the true resident, though he was the only name on the lease. The Tenant also requested a conditional order because the occupant lost her job. The Landlord contested the sustainability of the tenancy, noting the Tenant has another residence and has paid very little since the application was filed.

The ruling

The tenancy is terminated effective September 30, 2025. The Tenant is ordered to pay $6,615.31 to the Landlord if the tenancy is terminated, accounting for the rent deposit and interest. Alternatively, the Tenant can void the eviction by paying $11,845.44 on or before September 30, 2025. The request for a conditional order was denied due to lack of evidence regarding the sustainability of the tenancy.
