What happened
The Landlord applied for eviction after an occupant of the rental unit (the girlfriend of Tenant 1) vomited on the hallway carpet and elevator, poured undiluted bleach on the carpet in a failed cleaning attempt, and pulled a false fire alarm. The fire alarm resulted in a significant fine from the City of Toronto Fire Department. The Landlord sought termination of the tenancy and compensation for repair costs and the fire department fine.
The ruling
The LTB ruled that the Tenants are responsible for the damage and illegal act caused by their occupant. The Tenants are ordered to pay the Landlord $2,176.33 by January 31, 2026. This amount covers carpet cleaning, a fire department fine, and the filing fee. Relief from eviction was granted, meaning the tenancy continues provided the Tenants pay the amount on time and commit no further illegal acts for 24 months. Failure to comply allows the Landlord to apply for an eviction order without further notice.
