What happened
The landlord applied for an order to terminate the tenancy and evict the tenant due to the tenant, another occupant, or a person permitted by the tenant substantially interfering with the reasonable enjoyment or lawful right, privilege or interest of the landlord or another tenant. The landlord served two N5 notices alleging issues such as loud noises, fighting, high volume of guests, and guests tampering with the building's doors.
The ruling
The tenancy is terminated effective August 14, 2023. The tenant must move out by that date. If the unit is not vacated, the landlord may file the order with the Court Enforcement Office for enforcement. The tenant shall pay the landlord $25.32 per day for use of the unit starting June 13, 2023 until the move-out date, and $186 for the application filing fee. The landlord owes the tenant $790.70 for the rent deposit and interest, which is deducted from the amount owed by the tenant.
