What happened

The Landlord filed an L4 application to evict the Tenant for breaching a previous payment plan order. An ex-parte eviction order was issued. The Tenant filed a motion to set aside the eviction order. The Landlord requested a review of an initial decision on the set-aside motion, leading to a new hearing. This order is the result of the new hearing on the Tenant's motion to set aside the eviction.

The ruling

The Tenant's motion to set aside the eviction order (LTB-L-094028-24) is granted. The Board found that although the Tenant breached a previous payment plan, the breaches were minor and had been fully remedied. Considering the Tenant's circumstances as a senior with a long-standing tenancy, the Board determined it would be unfair to proceed with the eviction. The previous payment plan order from July 22, 2024, is reinstated, and the tenancy continues.
