What happened
The Landlord applied for an order to terminate the tenancy because the Tenant failed to meet conditions specified in a mediated settlement. An initial order (LTB-L-066710-25) was issued without a hearing. The Tenant then filed a motion to set aside that order, claiming he was seeking financial assistance and had recently started high-paying employment. The Landlord contested the Tenant's claims, arguing that the Tenant was untruthful and had provided no proof of income while arrears continued to grow.
The ruling
The Tenant's motion to set aside the eviction order was denied. The Board found that the Tenant breached the mediated settlement and failed to provide credible evidence of his ability to pay the $12,886.00 in arrears. The stay of the previous eviction order is lifted effective November 30, 2025.
