What happened

The Landlord applied to terminate the tenancy and evict the Tenants due to non-payment of rent. The Tenants, who have only been in the unit for seven months, faced financial difficulties due to Tenant 1's personal circumstances affecting her work capacity and Tenant 2 being a student with modest income. The Landlord sought a standard eviction order citing the rapid growth of arrears in a short tenancy.

The ruling

The tenancy is terminated effective September 30, 2025, unless the Tenants void the order by paying the full amount of arrears and filing fees. The Tenants are ordered to pay $5,933.18 for arrears up to the hearing date plus daily compensation of $70.52 until they move out. The Adjudicator delayed the eviction date slightly to assist the Tenants, who were experiencing financial hardship.
