What happened

The Landlord applied for the termination of tenancy and eviction due to non-payment of rent. The Tenant, who had resided in the unit for eight years, accumulated significant arrears while attending school and managing other debts. Although the Tenant is now employed full-time and made partial payments after the application was filed, the Landlord rejected a proposed $50 monthly repayment plan as insufficient. The LTB member found the plan unsustainable and unfair to the Landlord, ordering termination but delaying eviction to allow the Tenant time to move or pay in full.

The ruling

The tenancy is terminated effective August 31, 2025. The Tenant can void the eviction by paying $6,789.70 by July 31, 2025, or $8,839.43 by August 31, 2025. If the Tenant fails to void the order and moves out, they are ordered to pay the Landlord $2,300.55 (representing the balance after applying the rent deposit and payments made) plus daily compensation of $67.39 from June 26, 2025, until they vacate.
