What happened

The Landlord, a corporation, applied to evict the Tenant for rent arrears that accumulated following an Above Guideline Increase (AGI) order. The Tenant disputed a monthly parking charge, but could not provide a lease agreement to support his claim. At the hearing, the parties agreed to a 12-month repayment plan, allowing the tenancy to be preserved under specific conditions.

The ruling

The Tenant is ordered to pay the Landlord a total of $1,898.85, which covers rent arrears and the application fee. This amount is to be paid through a 12-month payment plan, starting June 1, 2025. The tenancy is not terminated but is preserved on the condition that the Tenant adheres to the payment schedule. If the Tenant defaults on any payment, the full balance becomes due, and the Landlord can apply to the LTB for an eviction order without further notice.
