What happened

The Tenant applied for the return of a last month's rent deposit and interest after the Landlord refused a general request to assign the lease. The Landlord mistakenly believed that because the tenancy was month-to-month, an assignment could only be for one month and would require a new lease at a new rent rate. The Tenant provided an N9 notice with 30 days' notice following this refusal, which the Board found to be valid under the Act.

The Landlord is ordered to pay the Tenant $1,002.95 by December 29, 2025. This includes the return of the $900.00 rent deposit, $54.95 in interest, and the $48.00 application fee. The Board found the Tenant's termination notice valid due to the Landlord's refusal to consent to a lease assignment.
