What happened
The Landlord applied to terminate the tenancy based on alleged rent arrears. The Tenants demonstrated through banking statements that the rent for July 2024 had been paid to the previous owner of the building. The current Landlord failed to provide the Tenants with updated payment instructions or direction upon taking over the property, leading to the erroneous issuance of an eviction notice.
The ruling
The Landlord's application to terminate the tenancy and evict the Tenants is dismissed. The Board found that the Tenants were not in arrears as the rent had been paid to the previous landlord, and the new Landlord failed to provide proper payment instructions.
