What happened

Tenant applied for an order determining that Landlord collected or retained money illegally. The Tenant proved that a $500 charge was illegally retained by the Landlord.

The ruling

The Landlord collected a rent deposit which was also referred to as a security deposit, which is not permitted by the Residential Tenancies Act, 2006. Therefore, the Landlord must repay the $500.00 to the Tenant. The Tenant is also entitled to be reimbursed for the cost of bringing this application.
