What happened

The Tenant applied for an order determining that the corporate Landlord gave a notice of termination in bad faith. The Landlord sent an email and a letter claiming that an individual representative needed the unit for personal use. However, under the Act, a corporation is prohibited from serving a personal use notice. The Landlord had also previously attempted to impose an illegal rent increase above the guidelines. The Tenant moved out in response to the notice and sought various remedies including rent abatement and general compensation.

The ruling

The Landlord is ordered to pay the Tenant a total of $20,229.17. This includes $14,400.00 in general compensation for bad faith, $2,000.00 for rent abatement due to the impact on the Tenant's enjoyment, $3,000.00 for the rent differential in the Tenant's new unit for one year, and moving costs. The Board found the corporate Landlord intentionally misled the Tenant to force an eviction after failing to secure an illegal rent increase.
