What happened
The Landlord applied for termination and eviction based on non-payment of rent (L1) and persistent late payment (L2). Before the hearing, the Tenant paid all rent arrears and the filing fee, leading to the discontinuation of the L1 application. For the L2 application, the Landlord provided evidence that the Tenant was late paying rent 7 out of 9 months. The Tenant cited employment schedule difficulties and claimed a verbal agreement with previous landlords to pay by the 7th of the month. The Tenant also raised maintenance issues regarding bed bugs as a reason to deny eviction.
The ruling
The LTB found the Tenant persistently paid rent late. The Landlord's application for non-payment was discontinued as the Tenant caught up on payments. The tenancy is allowed to continue on the condition that the Tenant pays the $186.00 filing fee by December 14, 2025, and pays full rent on time every month from January 1, 2026, through December 1, 2026. If the Tenant misses a payment, the Landlord may apply to terminate the tenancy without further notice.
