What happened

The Landlord applied for rent arrears and compensation for damages after the Tenants vacated the rental unit. The Landlord sought over $41,000 in damages including floor and cabinet issues. The Tenants admitted to minor carpet damage but argued most issues were normal wear and tear after a seven-year tenancy. The LTB member evaluated the claims and found that most alleged damages were attributable to wear and tear or poor workmanship and awarded a significantly reduced amount for carpet replacement in one bedroom.

The ruling

The Tenants are ordered to pay the Landlord a total of $10,144.32. This includes $9,016.99 in rent arrears and daily compensation, $1,169.41 for carpet damage, and the $186.00 filing fee, minus $228.08 for interest on the rent deposit. The Landlord's additional claims for over $40,000 in damages were dismissed as wear and tear or unproven.
