What happened
The Landlord applied to terminate the tenancy because the Tenants were persistently late in paying rent. The evidence showed the Tenants paid late 11 out of 12 times between December 2024 and October 2025. While the Landlord sought eviction due to financial strain, the Tenants requested relief, citing personal circumstances and maintenance issues, while asserting their current ability to pay on time.
The ruling
The Landlord's application for eviction is denied on the condition that the Tenants pay their full monthly rent on or before the first of each month for 18 months, starting January 1, 2026. The Tenants must also pay the Landlord $186.00 for the application filing fee by December 14, 2025. If the Tenants fail to meet the rent payment conditions, the Landlord may apply for an eviction order without further notice.
