What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit on the hearing date.
The ruling
The Landlord's application was granted, but the Tenant was provided conditional relief from eviction in the form of a repayment plan. The Tenant must pay the rent arrears of $8,750 and application costs of $186 in installments over 17 months, as well as continue paying the monthly rent. If the Tenant fails to make the required payments, the Landlord may apply to terminate the tenancy and evict the Tenant.
