What happened
The Landlord applied for eviction due to rent arrears. The Tenant contested the arrears, noting that rent payments were preauthorized. The Landlord explained that an above-guideline increase (AGI) and a subsequent annual increase created a compounding balance shortfall. By the hearing date, the Tenant had paid most of the arrears, leaving a small balance of $121.46.
The ruling
The tenancy is terminated effective November 30, 2025, unless the Tenant voids the order by paying $121.46 on or before October 31, 2025, or $2,519.09 (which includes November rent) on or before November 30, 2025. The Landlord waived the filing fee. If the tenancy terminates, the Landlord actually owes the Tenant $3,620.06 due to the rent deposit and interest exceeding the current arrears.
