What happened

The Landlord applied to terminate the tenancy and evict the Tenants based on persistent late payment of rent. Between May 2024 and April 2025, the Tenants paid rent late 12 times. However, since receiving the N8 notice in April 2025, the Tenants demonstrated improvement by paying rent in full and on time for four consecutive months (May through August 2025).

The ruling

The tenancy continues provided the Tenants adhere to strict payment conditions. The Tenants are ordered to pay September 2025 rent by September 16, 2025, and all subsequent rent from October 2025 to September 2026 in full and on time. Additionally, the Tenants must reimburse the Landlord's $186.00 filing fee by September 13, 2025. Failure to comply allows the Landlord to apply for an ex parte eviction order.
