What happened

The Landlord applied to terminate the tenancy due to persistent late payment of rent. Evidence showed several late payments in early 2025. However, since filing, the Tenants and Landlord worked together to set up automatic debits, resulting in on-time payments for recent months. The Landlord indicated they wished to preserve the tenancy rather than terminate it immediately.

The ruling

The tenancy is allowed to continue on the condition that the Tenants pay their ongoing lawful rent in full and on time for a period of one year, starting February 1, 2026. If the Tenants fail to pay on time during this period, the Landlord may apply for an eviction order without further notice to the Tenants.
