What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit on the hearing date.

The ruling

The tenancy will be terminated on May 31, 2023 unless the tenant pays $230.52 by April 30, 2023 or $2,245.01 by May 31, 2023 to void the order. The landlord is entitled to compensation of $66.23 per day for the tenant's continued occupation of the unit after April 14, 2023. The amount of the rent deposit and interest owed to the tenant exceeds the amount owed to the landlord.
