What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants due to persistent late payment of rent. At the hearing, Tenant 2 requested a closed hearing based on privacy concerns and an adjournment to seek legal counsel after Duty Counsel identified a conflict of interest. Both requests were denied as the Tenant failed to meet the legal tests for privacy overriding the open court principle and had sufficient notice to secure counsel. The evidence showed the Tenants paid rent late 12 out of 12 times in the year preceding the application, and failed to pay rent for several months leading up to the hearing.

The ruling

The tenancy is terminated effective October 31, 2025. The Tenants are ordered to pay the Landlord $6,102.85 for compensation up to June 9, 2025, plus $85.13 per day for each day they remain in the unit after that date. Eviction was postponed until October 31, 2025, considering the Tenant's ten-year residency and the needs of his children attending post-secondary education.
