What happened

The Landlord applied to evict the Tenant for non-payment of rent. The Tenant, a long-term senior resident, admitted to the arrears but argued the Landlord failed to negotiate a repayment plan in good faith, instead sending threatening letters with unlawful charges. The ruling

The Board denied the Landlord's application to evict the Tenant. Instead, the Tenant was granted relief from eviction and placed on a conditional payment plan. The Tenant must pay the total arrears of $4,222.00 in monthly installments of $150.00, in addition to the regular monthly rent. This decision was based on the Tenant's long-standing tenancy, age, disability, and the Landlord's failure to negotiate a repayment plan in good faith. If the Tenant defaults on the plan, the Landlord can re-apply for eviction.
