What happened
The Landlord applied to terminate the tenancy because they intend to demolish the residential complex (a duplex) to build a new 8-unit building. The Tenant challenged the good faith of the application, arguing the purchase of the property was not an arms-length transaction and that the application was premature due to a lack of construction permits. The Landlord had already obtained a demolition permit and paid the required compensation to the Tenant.
The ruling
The LTB ordered the termination of the tenancy effective January 31, 2026. The Landlord successfully demonstrated a good faith intent to demolish the unit, having secured the necessary demolition permits. Despite finding the Landlord's credibility suspect regarding the property purchase, the adjudicator determined the demolition plan was genuine. The eviction was postponed until the end of January 2026 to provide the Tenant with relief given their low income and long-term residency.
