What happened
The Landlords applied for termination and eviction based on non-payment of rent. A previous order was issued in June 2025, which the Tenants requested be reviewed. The primary dispute during the review hearing concerned the move-out date of the Tenants and whether a binding settlement agreement had been reached through a third party. The Tenants claimed they reached an agreement with an individual named 'Simmer', whom they believed was authorized to act for the Landlords. The Landlords denied authorizing this individual to negotiate on their behalf.
The ruling
The LTB terminated the tenancy effective May 7, 2025. The Tenants were ordered to pay the Landlords $6,197.86, representing rent arrears and the filing fee, after deducting the rent deposit, interest on the deposit, and a partial payment made after the application was filed. The Tenants' claim of a settlement agreement was rejected.
