What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit on the hearing date.

The ruling

The Landlord's application to terminate the tenancy and evict the Tenants due to non-payment of rent is granted. The Tenants can void the order by paying $28,638 by June 30, 2024 or $31,238 by July 25, 2024. If the Tenants do not void the order, the tenancy will be terminated and the Tenants must vacate the unit by July 25, 2024. The Tenants will owe the Landlord $24,347.65 plus daily compensation of $85.48 from June 13, 2024 until the date they vacate.
