What happened

The Tenants requested a review of an eviction order issued for non-payment of rent, claiming they missed the original hearing because Tenant 1 confused the date with a family court matter. Tenant 1 also alleged the Landlords filed for eviction in bad faith to avoid reimbursing over $4,200 in out-of-pocket repair costs. The Landlords opposed the review, noting rent arrears exceeded $14,000.00 and no payments had been made since April 2025.

The ruling

The request for review is denied. The original order (LTB-L-056068-25) terminating the tenancy and ordering eviction remains in effect. The stay of the original order is lifted immediately due to the substantial rent arrears exceeding $14,000.00 and the Tenants' lack of diligence in attending the original hearing.
