What happened

Landlord applied for an order to terminate the tenancy and evict Tenants because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year. The Landlord also claimed compensation for each day the Tenant remained in the unit after the termination date.

The ruling

The tenancy is terminated effective September 2, 2024. The Tenant must move out by that date. If the unit is not vacated, the Landlord may file the order with the Court Enforcement Office (Sheriff) to enforce the eviction. The Tenant must pay the Landlord $9,720 for use of the unit from April 1 to August 13, 2024, plus $72 per day from August 14 until the Tenant moves out. The Tenant must also pay the Landlord $186 for the application filing fee. The Landlord owes the Tenant $2,240.41 for the rent deposit and interest, which is deducted from the amount the Tenant owes. The total amount the Tenant owes the Landlord is $7,665.59.
