What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants for personal use (N12). The Landlord intended to move into the basement unit of the residential complex. However, the LTB member found that the N12 notice served to the Tenants was defective because it failed to identify that the notice specifically applied to the basement unit and provided an incorrect termination date that did not align with the end of the tenancy period.

The ruling

The Landlord's application to terminate the tenancy for personal use was dismissed. The N12 notice was found to be legally invalid because it did not specify the rental unit (basement) and listed an incorrect termination date that did not fall on the last day of the rental period.
