What happened

The Landlord applied to terminate the tenancy and evict the Tenant due to non-payment of rent. The Tenant contested the Landlord's standing, claiming the Landlord was not his landlord because he had not signed a lease with her after the previous landlord (her husband) passed away. The Tenant also attempted to raise maintenance or other issues under section 82 but failed to comply with disclosure rules.

The ruling

The tenancy is terminated effective December 15, 2025. The Tenant is ordered to pay $9,371.48 to the Landlord for rent arrears up to the hearing date and the filing fee. The Tenant can void the eviction by paying the total arrears and fees by specific deadlines ($9,936.00 by Nov 30 or $10,586.00 by Dec 15). Daily compensation of $21.37 is owed from November 5, 2025, until the Tenant vacates.
