What happened
This case involves multiple reviews of an original non-payment of rent application. The Landlord requested a review of a previous review order because he did not receive notice of the hearing. The LTB granted the Landlord's review, then granted a previous Tenant review due to a serious error in the original order regarding bank statements. Finally, in a de novo hearing, the LTB determined that the Tenant owed rent arrears despite the Tenant's claims of unrecorded cash payments, but granted conditional relief from eviction due to the Tenant's long-term tenancy and financial hardship.
The ruling
The LTB set aside previous review orders and issued a new order. The Tenant is found to owe $4,114.00 in rent arrears. However, the Tenant is granted relief from eviction on the condition that he pays the ongoing monthly rent in full plus $50.00 per month towards the arrears starting December 15, 2025. Failure to meet any payment allows the Landlord to apply for an ex parte eviction order under Section 78.
