What happened

The Landlord filed applications for an order to terminate the tenancy due to non-payment of rent (L1) and persistent late rent payments (L2). The Tenant did not attend the hearing. Based on the Landlord's uncontested evidence, the Board found the Tenant had a history of paying rent late and was in arrears. The tenancy was terminated on a non-remedial basis.

The ruling

The tenancy is terminated due to the Tenant's persistent late rent payments. The Tenant must move out of the rental unit by May 12, 2025. The Tenant is ordered to pay the Landlord $2,979.86 for rent arrears and filing fees, after deductions for payments and the rent deposit. Additionally, the Tenant must pay $70.75 for each day they occupy the unit after April 24, 2025. The eviction cannot be voided by payment because it is based on the persistent late payments.
