What happened

The Landlord applied to terminate the tenancy because she sold the rental unit and the Purchaser requires the unit for her own residential occupation. The Tenant, who is the sister of both the Landlord and the Purchaser, argued the application was in bad faith due to a family dispute. The Board found the Purchaser's intent to downsize after her husband's death was genuine.

The ruling

The tenancy is terminated effective November 30, 2025. The Tenant is ordered to pay $762.96 for use and occupation up to the hearing date, plus $11.56 daily until she vacates. Due to the Tenant's long-term residency (9 years) and the presence of grandchildren and pets, the LTB granted a delay in eviction until the end of November to facilitate finding new housing.
