What happened
The Landlord applied for an order to evict unauthorized occupants and receive compensation after the sole tenant passed away. The Landlord discovered during a separate hearing that the tenant had died in December 2024 and her family members remained in the unit. The Landlord refused to create a new tenancy with the occupants and sought their removal as the original tenancy was legally terminated 30 days after the tenant's death.
The ruling
The tenancy was declared terminated effective January 18, 2025. The Unauthorized Occupants are ordered to vacate the rental unit on or before August 26, 2025. They are also ordered to pay the Landlord $14,956.32, which includes compensation for the unauthorized use of the unit and the filing fee. If they fail to vacate, the Landlord may enforce the eviction through the Sheriff after August 27, 2025.
