What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Landlord served the Tenant with an N4 notice, but the N4 notice was found to be invalid as it did not clearly set out the rent due. The Landlord elected to proceed with the hearing to seek an order for payment of the rent arrears, but not termination of the tenancy.

The ruling

The Tenant shall pay the Landlord $28,686, which includes $28,500 in rent arrears and $186 in application filing costs. If the Tenant does not pay the full amount by May 13, 2023, the Tenant will start to owe interest at 6% annually on the outstanding balance.
