What happened
The Landlord, a corporation, filed to evict the Tenant for rent arrears. The Tenant, who had lived in the unit for 10 years, fell behind on rent due to illness. Despite the Landlord's opposition and a separate application for persistent late payments, the Board granted the Tenant relief from eviction. This was conditioned on a payment plan to clear the $9,443.59 in arrears and costs, taking into account the Tenant's financial situation and the importance of the tenancy to her and her child.
The ruling
The tenancy is not terminated. The Tenant is ordered to pay the Landlord $9,443.59 for rent arrears and costs. This amount is to be paid via a structured payment plan, starting with a catch-up payment for recent rent, followed by an initial arrears payment of $443.59 by April 20, 2025, and subsequent monthly payments of $600.00. The Tenant must also pay ongoing rent in full and on time. If the Tenant fails to comply with the payment plan, the Landlord can apply for an eviction order without notice.
