What happened

The Landlord applied for an order to terminate the tenancy under Section 78, alleging the Tenant failed to meet conditions of a previous LTB order issued in February 2025. An ex parte order was issued in May 2025 granting eviction. The Tenant subsequently filed a motion to set aside that order. At the hearing, the parties reached a consent agreement to set aside the eviction and reinstate the previous order.

The ruling

The LTB granted the Tenant's motion to set aside the eviction order dated May 27, 2025. By consent of both the Landlord and the Tenant, the eviction is cancelled, and the parties will continue to be bound by the terms of the previous order issued on February 19, 2025.
