What happened

The Landlord sought to terminate the tenancy based on non-payment of rent, substantial interference with enjoyment, alleged damages, and personal use. However, the Landlord's notices were found to be riddled with procedural errors: the N4 was signed after its alleged service date and filed before the termination date; the rent increase leading to arrears was void for lack of proper notice; the N5 was vague and improperly drafted; and the Landlord failed to pay the mandatory compensation for the N12 notice.

The ruling

The Landlord's applications to terminate the tenancy and for monetary compensation were dismissed in their entirety. The Landlord was ordered to pay a $50.00 administrative fine to the Board for unreasonable conduct during the hearing, including providing misleading information and interrupting the Member.
