What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenants because the rental unit is a superintendent's premises and the Tenant's employment as a superintendent ended on April 15, 2025. The Tenants argued that a clause in their employment contract allowed them to remain in the unit at market rent after their employment ended, effectively creating a new tenancy. The Landlord sought possession to house new superintendents currently living in inadequate space.
The ruling
The LTB ordered the termination of the tenancy and eviction of the Tenants by October 31, 2025. The Tenants must pay the $186.00 application fee and daily compensation of $31.70 from September 1, 2025, until they vacate. The request for a six-month delay was denied, but a two-month extension was granted considering the Tenants' unemployment and the Landlord's need for the unit for new staff.
