What happened
The Landlord filed an application to evict the Subtenant, who was overholding after the fixed-term subtenancy agreement ended on August 31, 2024. The Landlord had provided 75 days' notice for the Subtenant to vacate as the original Tenant intended to return. The Subtenant failed to vacate and also stopped paying rent since June 2024. The Subtenant contested the validity of the sublease and notice but was found not credible by the Board.
The ruling
The Board ordered the eviction of the Subtenant for overholding after the subtenancy agreement expired. The Subtenant is required to vacate the rental unit by April 22, 2025. Additionally, the Subtenant must pay the Landlord $201.00 for the application filing fee. If the amount is not paid by the deadline, interest will accrue at 5.00%.
