What happened
The Tenants requested a review of a previous order, claiming the Board made a serious error by calculating rent arrears up to the date the Landlord discovered the unit was vacant, rather than when the Tenants actually moved out. The Tenants argued that since they were served an N4 notice asking them to leave, arrears should stop on their move-out date. The adjudicator found that a serious error had occurred and reheard the application to determine the correct move-out date and resulting arrears.
The ruling
The review request was granted, and the original order was cancelled and replaced. The tenancy was officially terminated as of August 1, 2025. The Tenants are ordered to pay the Landlord $2,811.80, which includes rent arrears up to the move-out date and the application fee, minus the rent deposit and accrued interest. Payment is due by December 31, 2025.
