What happened

The Tenant filed T1 and T2 applications seeking the return of an illegal security deposit and a rent abatement for substantial interference. The Landlord contested the LTB's jurisdiction, arguing the unit was exempt because of shared kitchen and bathroom facilities. The Board found the Act applies and ruled on claims regarding renovations, noise, and the Landlord moving a new occupant into common areas before the Tenant moved out.

The ruling

The Landlord is ordered to pay the Tenant $222.03 by January 23, 2026. This includes $100.00 for an illegal security deposit, a $69.03 rent abatement for interference caused by moving a new occupant into the unit early, and the $53.00 application filing fee.
