What happened

The Tenant applied for an order determining that the Landlord gave a notice of termination in bad faith. The Landlord served an N13 notice to convert the residential unit into office space for an insurance business. The Tenant alleged that the Landlord failed to obtain necessary municipal permits and that the unit was being 'staged' as an office rather than truly converted. The Landlord testified that the unit is used daily for business meetings, staff breaks, and storage.

The ruling

The Tenant's application for bad faith eviction (T5) is dismissed. The Board found that the Landlord successfully converted the residential unit into office space for an insurance business within a reasonable time after the Tenant vacated. The Tenant failed to meet the burden of proof to show that the Landlord acted in bad faith or failed to convert the premises.
