What happened
The Landlord applied for eviction due to persistent late payment of rent. The parties reached a mediated settlement which resulted in a consent order. Subsequently, the Tenants requested a review of that order, specifically asking for the order to be varied to require the Landlord to accept post-dated cheques as a method of payment. The Tenants claimed they were not satisfied with the payment terms and that their representative should have raised concerns during the initial proceeding.
The ruling
The Tenants' request for a review of the consent order dated August 8, 2025, is denied. The Board found no serious error in the original proceeding or the resulting order. The original order remains in full force. The Board clarified that it does not have the jurisdiction to order a landlord to accept post-dated cheques.
